Oregon Pedestrians Hit by Cars, Trucks, Bikes, or Motorcycles

Oregon rules of the road are supposed to protect pedestrians from injury. Unfortunately, not everyone follows the rules.

Distracted drivers don’t see people in the crosswalk and run into them. I represented one young Portland woman who was crossing with the light on a marked crosswalk. The driver did not see the red light.

Sometimes, bicycle riders do not follow the rules and appear unexpectedly as a pedestrian steps off the curb. Bicyclists need to follow the rules, too. Oregon law says bicyclists must make some provide an “audible warning” before they pass pedestrians. If bicyclists don’t follow the rules and cause injury, then you have a claim against them.

Truck drivers often have problems seeing pedestrians when they make turns in urban areas.

Sadly, sometimes people do not look before backing up. I had the sad duty of advising a Central Oregon family of their rights after their two-year old was killed when someone backed out of their driveway.
