In 1984, Attorney General Dave Frohnmayer appointed Jeff Merrick to a one-year “Honors Attorney” in the Trial Division of the Oregon Department of Justice, and Jeff never left Oregon.
 
Since that time, Jeff Merrick has worked with -- and fought against -- some of the best lawyers in the country on some of the most complicated cases ever seen in Oregon and the United States.

Examples include the following:

• Represented more than 200 homeowners in The Capes litigation, which involved landslide and construction defect claims on the Oregon Coast.
• Pharmaceutical product liability. Mr. Merrick was the first lawyer to file and settle a Fen-Phen case, before fenfluramine was withdrawn from the market and before commencement of the multidistrict litigation. Mr. Merrick represented people in multidistrict litigation who were hurt by breast implants and Norplant.
• National class action alleging consumer fraud against Bausch & Lomb.
• Product liability, negligence, and professional negligence cases.

In 2000, Jeff Merrick left his big law firm to practice on his own, providing more personal and superior service to fewer clients. He did well for his clients and retired in 2003. However, after earning an advanced law degree and teaching at the law school, Jeff decided to return to the practice of law in 2005 because he loves the practice of law.

Brain Injury: Traumatic brain injury to children who fell from windows and adults who suffered traumatic brain injury.  Anoxic brain injury from anesthesia malpractice.

Wrongful termination:  Has helped people fired for unlawful reasons, including age discrimination or for seeking better care for nursing home residents, etc.

Dangerous Playgrounds: Helped boy who lost his eyesight on a tree branch at a camp for children because the camp did not trim trees over a path children used after dark.

Defective Products: Sometimes, things cause injury.  A baby carrier breaks, dropping the baby. A drug causes an undisclosed side-effect. A machine at work crushes a leg or cuts off a finger. (Workers’ Compensation might not be your only legal right to compensation.)

Toxic exposure: Represented families exposed to toxic mold in their home.  Helped hundreds exposed to toxic drugs.  Mr. Merrick taught an upper-level law school class on “Toxic Torts.”

Medical malpractice: Unfortunately, mistakes happen.  If they happen because a doctor failed to do something that a reasonably prudent doctor would ordinarily have done, then the law provides a remedy. I’ve helped many victims of medical malpractice.

Sexual attacks, molestation, and other crimes:  Crime victims can sue the criminals.  Sometimes they can even sue others who have allowed a criminal access to the victim.  For example, when a workman, who had a criminal record, attempted to rape a tenant, we sued the landlord for not doing a background check before giving the convict a pass key.

Falls in grocery stores, apartments and other places. When certain places invite people to walk in areas containing slip and trip hazards, the law provides a remedy.
